Unethical Medical Practitioner Serves Lengthy Prison Term

In a recent retrial, a former fraudulent anesthesiologist has been sentenced to 15 years in prison by the Regional Court of Kassel for causing ten instances of serious bodily harm and deaths in three cases. The woman, aged 54, had been working in a hospital in Fritzlar, Schwalm-Eder district, for years using a forged certification.

Initially, the Regional Court sentenced the woman to life imprisonment with the determination of the particular gravity of the offense for three cases of murder and ten attempted murders in May 2022. However, the Federal Court of Justice (BGH) partially overturned the verdict and sent the case back for a retrial due to insufficient evidence of the intention to kill.

During her time as an anesthesiologist, the woman's treatment errors led to the deaths of multiple patients and injuries for others. The 6th Large Criminal Chamber of the Regional Court found these findings proven in the first trial. However, the woman successfully appealed against the verdict.

The 10th Large Criminal Chamber of the Regional Court, following the demands of the public prosecutor's office, ruled that no intent to kill could be established. In the new trial, the plaintiffs had requested that the woman be sentenced to life imprisonment for murder and that the particular gravity of the offense be determined. Her defense attorneys pleaded for a sentence ranging from seven to eight years for dangerous bodily harm or eight years for dangerous bodily harm resulting in death.

Although the new verdict is not yet legally binding, it represents a significant reduction in punishment compared to the initial sentence of life imprisonment. Further details on the reasoning behind the reduced sentence and the new verdict's legal implications are yet to be released.
