A Dubious Saga of Injustice: Contested Forced Marriage and Accusations of Rape - The Krefeld Acquittal

Forced marriages and rape result in acquittals - Unwarranted marriages and sexual assault: not guilty verdicts

In an unexpected turn of events, a contentious trial regarding an alleged forced marriage and an astounding 140 instances of rape concluded with acquittals in record time. Two Syrian men, aged 30 and 39, stood accused at the Krefeld Regional Court.

The prosecution case hinged heavily on the testimonial account of the girl, a 15-year-old at the time. They alleged that these two Syrian men had coerced the minor into marriage in Krefeld through the use of violence. The younger man was also charged with multiple, repetitive acts of rape over several months.

The court, however, expressed doubts, triggering a psychiatric evaluation of the alleged victim's credibility. Upon examination, the psychiatrist dismissed her incriminating statements as implausible and contradictory.

"Chat logs paint a different picture"

Despite the prosecution's assertions, neither the forced marriage nor the numerous rapes of the girl were substantiated, as outlined by the presiding judge. "Chat logs paint a different picture."

The 15-year-old had penned heartfelt messages to the alleged assailant several times, expressing her affection by stating, "I miss you, I kiss your hands and feet," and sending affectionate emojis. Furthermore, her phone was found to contain several photos capturing intimate moments. "I was pressured into this," the now 18-year-old claimed.

The defendants faced charges of kidnapping, bodily harm, and attempted coercion. The 30-year-old was additionally charged with almost 140 counts of rape.

Accused of False Accusations due to Family Feud?

The two accused Syrians, represented by their legal counsel, maintained their innocence, contending that the accusations were fabricated. The young woman may have concocted them in retaliation for a family dispute.

The 30-year-old defendant, who had lawfully wed the girl according to Islamic law on January 3, 2022, in the Netherlands, portrayed their relationship as loving. The engagement had reportedly been celebrated in Syria in 2021. Two months later, the then 15-year-old moved to Germany. The public prosecutor has planned to examine the possibility of initiating criminal proceedings against the young woman for making false accusations and perjury.
